Global Privacy Policy

Corkcicle, LLC (“Corkcicle”, “we”, “us” or “our”) is committed to respecting your privacy. The following policy describes how we collect, protect, use, process and share information we receive, including in person, by phone, through mail or email or through our website www.corkcicle.com, any other Corkcicle-owned and/or operated website, mobile sites, or social media accounts (collectively, our “Sites”). By accessing or using our Sites or otherwise disclosing information to Corkcicle, you consent to our collection, use, processing, and sharing of your information in accordance with this Global Privacy Policy (this “Policy”).

Information We Collect About You and How We Collect It

We collect several types of information from and about users of our Sites, including information:

  • By which you may be personally identified, such as name, postal address, email address, telephone number, customer identification number or any other identifier by which you may be contacted online or offline;
  • That is about you but individually does not identify you, such as order number; and
  • About your usage of the Sites, including internet connection, the equipment you use to access the Sites, and usage details.

How Does Corkcicle Collect Information?

Information You Provide Directly to Us

We collect personal information you provide directly to us, for example, when you request to receive emails or newsletters from us, or purchase products or services from us. The types of information we may collect include:

  • Transaction Information. We may collect and store information about the products you purchase and your billing information, including transaction records, fulfillment details and correspondence with you. We may also collect limited payment information from you, such as payment method and payment card information; however, we do not store full payment card numbers and our third party payment processor processes all transactions.
  • Account Information. When you register for an account on the Sites, you will need to provide us with certain personal information to complete the registration, including information that can be used to contact or identify you, which may include your name, email address, mailing address, username, password, and phone number.
  • Content You Submit. We collect the content you submit to the Sites. This includes your posts and comments or responses to surveys or product reviews.
  • Other Information You Provide to Us. We collect information that you directly provide to us through any other means.

Information We Collect Automatically

When you access or use the Sites, the types of information we may automatically collect about you include:

  • Usage Information. We may collect information about your usage of, and interaction with the Sites. For example, we may collect and store statistics and other information about the online activities of our users on an aggregated (collective) basis, including tracking the number of people who view each page to learn which features are the most popular.
  • Mobile Device Information. We may collect information about the mobile device you use to access or use the Sites, including the hardware model, operating system and version, mobile network information and information about your use of our mobile applications. With your permission, we may also collect information about the precise location of your device using methods that may include GPS, wireless networks, cell towers, and Wi-Fi access points. You may stop the collection of this information at any time by changing the settings on your mobile device but note that some features of a mobile application may no longer function if you do so.
  • Log Information. When you access or use the Sites, our servers may automatically record certain log file information, such as your Internet Protocol (“IP”) address, operating system, browser type and language, referring URLs, access times, pages viewed, links clicked and other information about your activities on the Sites.
  • Information Collected by Tracking Technologies. We and our service providers use various tracking technologies, including cookies, web beacons, and flash cookies to collect information about you when you interact with our Sites, including information about your browsing and purchasing behavior.

Cookies are small data files stored on your hard drive or in device memory that help us improve the Sites and your experience, see which areas and features of the Sites are popular and count visits. Most web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove or reject browser cookies. Please note that if you choose to remove or reject cookies, this could affect the availability and functionality of the Sites.

Pages of our Sites and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).

Certain features of our Sites may use local stored objects (or Flash cookies) to collect and store information about your preferences and navigation to, from, and on our Sites. Flash cookies are not managed by the same browser settings as are used for browser cookies.

Information We Collect From Third Parties

We may receive information that third parties provide us, which may include information about you. For example, we may collect information about you when you post content to our pages or feeds on third party social media sites. This Policy does not apply to information collected through or by any third party. If you have any questions about such third parties’ privacy practices, you should review their privacy policies.  

How Does Corkcicle Use Collected Information?

We may use your information for various purposes related to our operations and your use of the Sites. For example, we may use your information to:

  • Provide, maintain and improve our Sites and provide you with relevant information and content, including subscriptions to our email list and newsletters.
  • Send you technical notices, updates, security alerts and support and administrative messages.
  • Respond to your comments, questions and requests and provide customer service. 
  • Monitor and analyze trends, usage and activities in connection with our Sites.
  • Detect, investigate and prevent fraudulent transactions and other illegal activities and protect the rights and property of Corkcicle and others.
  • Maintain appropriate records for internal administrative purposes.
  • To comply with legal and regulatory requirements, required disclosures and choices and controls that may be available.
  • To personalize online content and user experiences.
  • To perform operational functions in connection with our business, including data analysis, audits, developing and improving products and services, enhancing the Sites and identifying usage trends.
  • To deliver our products and services to you upon your purchase.
  • To deliver marketing materials or other advertising content to you.
  • Link or combine with information we get from others to help understand your needs and provide you with a better experience.
  • In connection with your employment (to the extent applicable to you).
  • Carry out any other purpose described to you at the time the information was collected.

We may use or share non-personal, non-individual statistical or demographic information in aggregate form with our marketing partners, advertisers or other third parties for research purposes. Such aggregated and de-identified (anonymized) information cannot reasonably be used to identify you and, therefore, no longer constitutes personal information. Such de-identified and/or aggregated information which does not identify individuals is not subject to this Policy.

In the event that you refuse to provide certain categories of information to us, our purposes for the collection of such data may be hindered. In some cases, our capability to provide our goods and/or services to you may be hindered.

What Legal Bases Does Corkcicle Rely Upon In Processing Information?

Our processing of the data we collect from you is justified on one or more of the following legal bases, as provided for in the applicable data law of your jurisdiction:

  • Your consent.
  • Our legitimate interests as specified in this Policy or other disclosures.
  • To protect your vital or legitimate interest.
  • The necessity to perform a contract to which you are a party or in order to take steps at your request prior to entering into a contract.
  • The necessity to comply with a legal obligation to which we are subject.
  • The necessity to establish, exercise or defend legal claims.
  • The necessity to process for reasons of substantial public interest, on the basis of applicable law, rule, or regulation.

How Long Does Corkcicle Retain Information?

We keep your personal information that we obtain about you through these Sites for no longer than is reasonably necessary for the purpose(s) for which it was collected.  In certain cases, personal information may be kept for an extended period of time in order to comply with legal obligations, or for the establishment, exercise or defense of a legal claim, in accordance with applicable data protection laws.

Who Does Corkcicle Share Information With?  

We may share information about you as follows or as otherwise described in this Policy:

  • With vendors, consultants and other service providers who need access to such information to carry out work or perform services on our behalf (including our third-party payment processor).
  • With third party businesses to provide you with information about products and services that may be useful to you.
  • In response to a request for information if we believe disclosure is in accordance with, or required by, any applicable law, rule, regulation or legal process.
  • If we believe your actions are inconsistent with our Terms of Use (incorporate herein by reference) or other policies, or to protect the rights, property or safety of Corkcicle or others.
  • In connection with, or during negotiations of, any merger, acquisition, sale of assets or any business, other change of control transaction or financing.
  • To comply with any court order, law or legal process, including to respond to any government or regulatory request.
  • To enforce any agreement we may have with you.
  • Between and among Corkcicle and any current or future parent, subsidiary and/or affiliated company.
  • With your consent or at your direction. 

We also may share aggregated or de-identified information, which cannot reasonably be used to identify you.

International Transfers of Your Personal Information

In certain situations, we may transfer your personal information to countries outside of your jurisdiction. Certain destination countries may not have the same level of protection for personal information as your jurisdiction. It is possible that foreign law enforcement and other authorities may be able to access your personal information following an international transfer of your personal information. In any case, any international transfer of your personal information will be conducted in a manner that complies with the applicable law of your jurisdiction. Transfers of personal information outside of your jurisdiction will take place in the following manner:

  • Transfers of personal information to foreign receiving entities will be conducted with measures to provide an adequate level of protection using an acceptable data transfer mechanism, either through law, binding corporate rules, approved Codes of Conduct and certifications, or binding agreement.
  • In some cases, the destination jurisdiction may be recognized by your jurisdiction as providing adequate data protections.
  • In exceptional cases, we may rely upon certain statutory or regulatory exceptions, including your consent, necessity to conclude or perform a contract, the provision of a benefit to you, or other applicable exceptions as provided by the law of your jurisdiction in making an international transfer of your information.

Sale of Your Personal Information

Corkcicle does not currently sell your personal information to other parties.

Individual Rights

The law of your jurisdiction may provide you with certain rights regarding our use of your personal information.

Subject to any exceptions under applicable law, you may have the following rights with respect to your personal information collected by Corkcicle:

  • The right to know and access. You may have the right to request Corkcicle disclose (i) a copy of the personal information that we collect about you; (ii) the categories of personal information that we collected about you; (iii) the categories of purposes for which such personal information was disclosed; (iv) the categories of sources such personal information was collected for; and (v) the categories of third parties such personal information may have been shared with.
  • The right to deletion. You may have the right to request that Corkcicle delete the personal information that we or our vendors collected about you. There may be circumstances under which we will be unable to delete your personal information, such as if we need to comply with our legal obligations or complete a transaction for which your personal information was collected. If we are unable to comply with your request for deletion, we will let you know the reason why.
  • The right to rectification. You may have the right to obtain from us the rectification of inaccurate personal data concerning you and to have incomplete personal data completed.
  • The right to objection or restriction to Processing. You may have the right to object to or restrict the processing of your personal data on grounds relating to your particular situation. You can also object at any time to the processing of your personal data for marketing purposes. (Please note that even if you object to your use of personal data for direct marketing purposes, we will still send you transactional messages in relation to services that you have purchased from us. These include responses to your questions and information about a service you have purchased from us.)
  • The right to portability. You may have the right to receive the personal data concerning you which you have provided to a controller (or similarly defined term under applicable law) in a structured, commonly used and machine-readable format and have the right to transmit those data to another controller without hindrance from the controller.
  • The right to lodge a complaint. You may have the right to lodge a complaint with the relevant supervisory authority of your jurisdiction, place of employment, or the location where the issue that is the subject of the complaint occurred. In some jurisdictions, you may also have the right to bring suit against any processing entities that refuse to recognize other statutorily-provided rights.
  • The right to not be subject to automated decision making. You may have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or significantly affects you.
  • The right to refuse or withdraw consent. You may have the right to refuse to give consent and you may have the right to withdraw (with effect for the future) your previously provided consent to processing of your personal information at any time without any adverse negative consequences. Do note, however, that if you choose to withdraw consent, you may experience certain unavoidable consequences. For example, if you choose to withdraw consent for the international transfer of your personal information, we may be unable to provide you with certain goods or services. In addition, if you choose to withdraw consent, the lawfulness of any processing of your personal data that occurred prior to the withdrawal of your consent will not be affected.
  • The right to receive information about recipients. You may have the right to request to receive information about the public and private entities with whom we have shared personal information.
  • The right to limit the use of your sensitive personal information. We will request your explicit consent prior to collecting any of your sensitive personal information. In exceptional cases, we may rely upon applicable statutory exceptions in establishing a legal basis for processing your sensitive personal information. Your sensitive personal information may include your social security number, driver’s license, state identification card, or passport number; account log-in, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account; precise geolocation; racial or ethnic origin, religious, philosophical, or political beliefs, or union membership; the contents of your mail, email and text messages, except in cases where we are intended recipient of the communication; your genetic data; the processing of biometric information for the purpose of uniquely identifying you; personal information collected and analyzed concerning your health; or personal information collected and analyzed concerning your sex life or sexual orientation. You may have the right to request that we limit the use of your sensitive personal information for only the purpose of providing requested services and goods to you.
  • The right to opt-out. We will ask for your express consent prior to sending any commercial electronic messages to you, including via SMS texts or emails. You may opt-out of receiving promotional or marketing emails from us at any time by using the unsubscribe link located at the footer of any promotional or marketing email sent by us. Additionally, you may opt-out of mobile marketing for a specific mobile number at any time by replying “STOP” on your mobile phone/wireless device. Please allow 10 business days for us to process any marketing opt-out request. Do note that, in the case that you opt-out from promotional and marketing communications, we may still contact you for nonpromotional purposes, such as confirming an order or providing updates about your account.

If you choose to exercise any of these rights, Corkcicle will not discriminate against you in any way.

Exercising Your Rights

To exercise any of the aforementioned rights, contact us at Service@corkcicle.com or 1-866-780-0007. In connection with submitting a request, you must provide the following information: name, email, phone number, address (or U.S. state of residency or, if inapplicable, the non-U.S. country of residency) and you must state what type of request you are making.

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. In general, Corkcicle has the right to require you to provide written permission granting authority to your representative and for your agent to verify its identity directly with us, and we may deny a request from your representative who does not submit proof of authorization as we request.

The verifiable consumer request must provide sufficient information that allows Corkcicle to reasonably verify the requestor is the person about whom we collected personal information or an authorized representative and describe the request with sufficient detail that allows us to properly understand, evaluate, and respond to it. Corkcicle cannot respond to a request or provide personal information if we cannot verify the identity or authority to make the request.

Corkcicle will endeavor to confirm receipt of a request within 10 days following submission and provide information about how we will process the request. Corkcicle will endeavor to respond to a verifiable consumer request within 30 days of its receipt. We may deliver our written response by mail or electronically, at your option.

Sharing of Personal Information

Corkcicle may have collected and disclosed the following categories of personal information from consumers for a business purpose in the preceding 12 months:

  • Various identifiers, including, name, address, online identifier, Internet Protocol address, email address, account name, or other similar identifiers.
  • Personal information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)), including, telephone number or financial information.
  • Commercial information, including, records of products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.
  • Biometric information, including, behavioral characteristics, or activity patterns used to extract a template or other identifier or identifying information.
  • Internet or other similar network activity, including, browsing history, search history, information on a consumer's interaction with a website, application, or advertisement, including protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, the files viewed on our Sites (e.g., HTML pages, graphics, etc.), operating system, date/time stamp, and/or clickstream data in order to analyze trends in the aggregate and administer our Sites.
  • Geolocation data, including, physical location or movements           
  • Sensory data, including, audio, electronic, visual, or similar information.        
  • Professional or employment-related information, including, current or past job history or performance evaluations.
  • Educational information, including, transcript, student records, grades and performance, activities, school name or school ID.
  • Inferences drawn from other personal information, including, a profile reflecting a person's preferences, characteristics, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.
  • Protected classification characteristics, including, race, color, national origin, marital status, sex, veteran or military status.
  • Personal records, such as, power of attorney, family history or power of attorney.
  • Information received from a government entity or other third party.

Corkcicle may collect the above categories of personal information directly from you, indirectly as you interact with our Sites, from or through other third-party sources, including our customers or employees, or through email or other electronic messages between you and our Sites.

Corkcicle may have disclosed the categories of personal information set forth above for one or more of the purposes set forth in this Policy, including disclosure to a service provider or other third party of Corkcicle’s for a business purpose. Corkcicle will not collect additional categories of personal Information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice.

Third-Party Links

In an attempt to provide you with increased value, we may include third-party links on our site. If you click on a third-party link, you will be directed to that third-party’s website.  We have no control over these linked sites. Third-party sites have their own separate and independent privacy policies and practices, including in connection with their use or disclosure of information you disclose to them. Corkcicle is not responsible or liable for the content of any third-party site. We encourage you to check the privacy policies of third-party sites before providing your information to them. The fact that we may link to a third-party site or present a banner ad or other type of advertisement from a third party is not an endorsement, authorization, or representation of any affiliation by us with that third-party, nor is it an endorsement of their privacy or information security policies or practices.

Third-Party Analytics Services

We may allow third parties to provide analytics services and serve advertisements on our behalf and on behalf of others across the web and in mobile applications. These third parties may use cookies, web beacons, and other technologies to collect information about your use of our Sites and other websites, including your IP address, web browser, mobile network information, pages viewed, time spent on pages, links clicked, and conversion information. This information may be used by us and these third parties to analyze and track data, determine the popularity of certain content, deliver advertising targeted to your interests on our Sites, other websites and online services, and better understand your online activity. We may also work with third parties to serve ads to you on our behalf or on behalf of other advertisers on third-party platforms (such as Facebook or Google). As part of these ad campaigns, we or third-party platforms may convert information about you, such as your email address and phone number, into a unique value that can be matched with a user account on these platforms to allow us and others to serve you advertising that is customized to your interests. Note that the third-party platforms may offer you choices (including the right to opt-out) about whether you see these types of customized ads.

Children Under the Age of 16

Our Sites are not intended for children under 16 years of age. No one under age 16 may provide any personal information to or on the Sites. We do not knowingly collect personal information from children under 16. If you are under 16, do not use or provide any information on our Sites or on or through any of its features or provide any information about yourself to us, including your name, address, telephone number, e-mail address or any screen name or username you may use. If we learn we have collected or received personal information from a child under 16 without verification of parental consent, we will delete that information. Security

We use appropriate technical and organizational security measures designed to safeguard the personal information under our control from unauthorized access, use, and disclosure. Despite these measures, the confidentiality of any communication or material transmitted to or from us via the Sites by Internet or email cannot be guaranteed. Corkcicle encourages you to learn as much as you can about your privacy on the Internet.

How We Respond to “Do Not Track” Signals

Some web browsers have “Do Not Track” or similar features that allow you to tell each website you visit that you do not want your activities on that website tracked. At present, the Sites do not respond to “Do Not Track” signals and consequently, the Sites will continue to collect information about you even if your browser’s “Do Not Track” feature is activated.

Changes to Our Privacy Policy

We will change, amend and update this Policy from time to time to reflect changes in our privacy practices, technology, products and services, general business operations and industry. In the event of any change to our policies, we will post a revised policy on our Sites with a revised date. We reserve the right to change, amend and update this Policy at any time in our sole and absolute discretion, and such changes will be effective upon posting of the revised policy. In the event of a material change in our information collection and use practices, we will provide more prominent notice of such change. You should check this Policy on a regular basis to ensure you have reviewed and are familiar with the most current policy.

California Resident Privacy Rights

If you are a California resident, California law may provide you with additional rights regarding our use of your personal information; subject to exclusions from the rights granted under California law with respect to certain information governed by certain sector-specific privacy laws.

  • The right to deletion. California residents have the right to request that Corkcicle delete the personal information that we or our vendors collected about you. There may be circumstances under which we will be unable to delete your personal information, such as if we need to comply with our legal obligations or complete a transaction for which your personal information was collected. If we are unable to comply with your request for deletion, we will let you know the reason why.

If a California resident chooses to exercise any of these rights, Corkcicle will not discriminate against the California resident in anyway.

Corkcicle cannot respond to a request or provide personal information if we cannot verify the identity or authority to make the request.

 Corkcicle will endeavor to confirm receipt of a request within 10 days following submission and provide information about how we will process the request. Corkcicle will endeavor to respond to a verifiable consumer request within 45 days of its receipt. If we require more time (up to an additional 45 days), we will provide notice in writing explaining the reason for the extended time period. We may deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding the request receipt date. If we deny a request, we will provide a response explaining the reasons we cannot comply with a request, if applicable.

Sale of California Resident Personal Information

In the prior 12 months, Corkcicle has not sold personal Information of a California resident.

How We Respond to “Do Not Track” Signals

Some web browsers have “Do Not Track” or similar features that allow you to tell each website you visit that you do not want your activities on that website tracked.
